Interview: What not to reveal in your tax strategy

When preparing a document of information on the tax strategy implemented by a company, it is important to bear in mind the protection of corporate secrecy. Information covered by it is excluded from the obligation to provide it in the strategy. It is worth remembering about this exclusion in order not to reveal too much data in the published information - says Justyna Chylińska, tax transparency expert at Thedy & Partners, in an interview with the fpg24.pl portal.

By the end of December, entrepreneurs should publish information about the implemented tax strategy. What exactly is this information?

Information on the implemented tax strategy is a document containing information on the company’s activities in areas of key importance from the point of view of fulfilling its obligations under tax law, including, in particular, the procedures and processes in force in the company concerning the fulfilment of tax obligations, voluntary forms of cooperation with tax authorities, reporting of MDR tax schemes, transactions with related entities, planned and carried out restructuring activities, submitted applications for the issuance of individual interpretations of tax law and tax settlements made in the so-called tax havens.

Not all companies have to publish information about the strategy. Who exactly is obliged to do so?

The obligation to draw up and publish the so-called tax strategy applies only to tax capital groups, taxpayers in which the value of revenue earned in the tax year exceeded the equivalent of EUR 50 million and the so-called real estate companies, i.e. companies in which at least 50 per cent of the market value of assets on the first day of the tax year or on the last day of the year preceding the tax year was the market value of real estate located in Poland (or rights to such real estate) and the market value of such real estate exceeded PLN 10 million.

At the same time, entities that are a party to a co-operation agreement concluded with the Head of the National Tax Administration are exempt from the obligation to publish information on tax strategy.
