Companies will have to prepare an income tax report
Some companies will be required to prepare and publish a report on income tax paid. This is another mechanism to block the tax avoidance procedure.
A draft amendment to the Accounting Act and the Act on Statutory Auditors and Public Supervision, which provides for such changes, is already ready. The introduction of these regulations is the implementation into the Polish legal order of the Directive of the European Parliament and of the Council (EU) 2021/2101 of 24 November 2021 amending Directive 2013/34/EU as regards disclosure of information on income tax by certain undertakings and branches (Official Journal of the EU L 429 of 1.12.2021, pp.1-14).
According to the draft, there will be an obligation to prepare an income tax report by all large multinational enterprises (top-level parent entities of a group and stand-alone entities with, respectively, consolidated revenues – for top-level parent entities – and revenues – for stand-alone entities – exceeding the amount of EUR 750 million in two consecutive years) having their registered office or place of management in the territory of Poland, as well as non-EU multinational enterprises conducting business activity in Poland through a branch or subsidiary.
The draft assumes that entities will be required to prepare an income tax report for the first time for the financial year beginning after 21 June 2024.
The amendment is expected to come into force 14 days after its publication in the Journal of Laws. It is currently at the consultation stage.
