The National e-Invoice System in less than two months
On Friday, the Sejm passed a bill that will implement the National System of e-Invoices (KSeF) into law. The bill is now awaiting the President's signature.
The new regulations are to come into effect as soon as on 1 January 2022.
– The KSeF stipulates that initially – or, to be precise, during the first year – the governmental system may be used by entrepreneurs voluntarily. However, from 2023, there will be no such freedom – all companies will have to switch to the ministerial system. In order to encourage taxpayers to use the new opportunities, especially in 2022, the draft provides for certain preferences. One of them is a faster, 40-day deadline for VAT refunds. Normally, the tax office has 60 days to return the money. The second advantage, which the MF promotes, is the fact that the invoice will remain in the MF’s database and will never be destroyed or lost, so there will be no need to issue duplicates – points out Andrzej Kapczuk, tax advisor, partner at Thedy & Partners.
