The Ministry of Finance has published clarifications to the e-commerce package
The Ministry of Finance has published explanations to the VAT e-commerce package. This extensive document is dated 1 September and is 97 pages long.
In the explanations, the ministry focused on explaining the most important issues included in the VAT amendment, which introduced the e-commerce package. Many of the discussed topics are supported by examples.
The explanations analyse the most important solutions of the package, i.e.: intra-community distance sales of goods (WSTO), distance sales of imported goods (SOTI), the role of electronic interface operators (platforms), special procedure called One Stop Shop (OSS), special procedure called Import One Stop Shop (IOSS) or a simplified procedure for declaring and deferring tax payment for import of goods in consignments of a value not exceeding EUR 150.
– Changes in VAT related to the implementation of the e-commerce package have introduced many novelties in VAT settlements in international trade in B2C relations. These solutions are effective from 1 July 2021 and their main aim is to tighten VAT in e-commerce, including import of the so-called small consignments to the EU, while simplifying some VAT settlements – points out Andrzej Kapczuk, tax adviser, partner at Thedy & Partners.
The new regulations mean a change of VAT rules for Polish entrepreneurs operating in e-commerce sector, making cross-border supplies of goods and providing cross-border services to EU consumers (B2C transactions).
