Polish Deal published in the Journal of Laws

The tax package of changes under the Polish Deal has already been signed by the President and published in the Journal of Laws under item 2105. The new tax reality will thus become a reality on 1 January 2022.

There are many changes, and the modifications cover practically every sphere of tax law. Some of the novelties are revolutionary, others orderly. Unfortunately, a large group of them is unfavourable for taxpayers, and entrepreneurs should start preparing for many of them today.

– Changes in the payment of health contributions, minimum CIT from companies, novelties in the settlement of costs, including depreciation limitations, limitations in limits applicable to debt financing, unfavourable rules related to the settlement of leasing – these are only some of the unfavourable solutions that taxpayers will have to face from next year,” points out Michał Thedy, tax adviser, partner in Thedy & Partners.

Is 2022 only bad tax news for business?

– Fortunately, no. There will also be changes beneficial for taxpayers. One could mention, for example, modifications in the R&D relief or IP Box. There will be new reliefs, e.g. for robotisation or exceptionally creative employees. The rules for settlements according to Estonian CIT principles will also be more favourable. There will be certain simplifications in transfer pricing. Entrepreneurs can also count on a special window for dealing with issues, which will speed up the whole process, or they will be able to apply for the interpretation 590 – enumerates Łukasz Kupryjańczyk, tax adviser, partner at Thedy & Partners.

As you can see, there are many changes. The amendment of tax regulations within the framework of the Polish Order counts more than 140 pages (with justification it was almost 300). It is difficult to describe them all in one article. Thedy & Partners has been systematically analysing these regulations for 8 months and explaining them in its publications.

Now we invite you to contact us. This is because we are aware of the enormous effort that companies must now put in to prepare in time for the planned novelties.

Our team will

– will analyse your situation

– tell you which changes will apply and

– how to prepare for them in order to be able to apply them in practice from next year without any surprises
