7 June 2026 Has Passed – When Will Employees Be Able to Ask About Pay?
The EU deadline for implementing the Pay Transparency Directive (2023/970) has formally passed, yet Poland's implementing legislation remains in progress. What does this mean for employers, and how should organisations prepare?
From an EU perspective, 7 June 2026 marked the final deadline for transposing Directive 2023/970 on pay transparency and equal pay. In Poland, however, the implementing legislation is still working its way through the legislative process.
Current Status
In early May 2026, the Ministry of Family, Labour and Social Policy published a revised draft of the implementing act. The new version takes into account a number of comments submitted in response to the first draft, making the proposed provisions more precise – though some practical questions remain unanswered. The draft is currently at the stage of inter-ministerial consultations, public consultation and review by advisory bodies.
Importantly for employers: the draft provides for the act to enter into force six months after its promulgation. In practice, this means the new obligations are unlikely to apply before 2027.
Time to Prepare – How to Use It Wisely
The delay in implementation offers additional time for thorough, considered preparation – rather than a last-minute scramble. It is worth bearing in mind that Directive 2023/970 is not simply a set of rules to be aware of. Implementing it effectively requires:
- conducting a job evaluation process,
- establishing a non-discriminatory pay structure,
- reviewing and updating internal policies and documentation,
- equipping HR teams and managers with the right tools and knowledge,
- developing a well-thought-out employee communication strategy.
