MF announces new WHT regulations
New regulations concerning withholding tax (WHT) are to come into force as of 1 January 2022, as announced by the Ministry of Finance. However, the problem is that the amendment has been discussed for over 2 years.
As we have already informed you, the Ministry of Finance has once again postponed the effective date of the amended regulations on withholding tax (WHT). These are precisely the provisions concerning the WHT refund procedure. The relevant regulations postponed their entry into force until the end of 2021.
– The WHT refund procedure concerns the obligation to collect withholding tax at the domestic rate with the right to a full or partial refund. The amended regulations were to come into force on 1 January 2019. However, they are so problematic that the MF postpones their entry into force every six months, at the same time assuring that it is working on their amendment – recalls Łukasz Kupryjańczyk, tax advisor, partner at Thedy & Partners.
Now, the ministry is indicating the date of amendment of these regulations. It is to be 1 January 2022. According to the ministry’s communiqué, works on the amendment of the regulations in this scope are already at the final stage. The details of the amendment have not yet been announced.
