Mandatory KSeF from 2024
The Ministry of Finance has launched a public consultation on the draft amendments to the VAT Act, which will introduce the National e-Invoicing System as the mandatory one. The consultation and collection of comments will last until 23 December.
According to the draft, KSeF will be a mandatory system for all businesses from the beginning of 2024. From 2022, companies can use it voluntarily. The universality of the KSeF in Poland was agreed by the EU Council, but it postponed the date of its introduction just until 2024. Initially, the MF assumed that it would be 2023.
– As of 2022, the possibility of issuing invoices via the ministerial system is voluntary and is one of the permitted forms of documenting sales alongside paper and electronic invoices. The use of KSeF is therefore voluntary for two years and the MF encourages its use so that from 2024 it is possible to switch to it smoothly and without hassle, as it will then become mandatory, explains Grzegorz Arczewski, senior manager at Thedy & Partners.
Switching to the KSeF gives entrepreneurs certain advantages. These include faster VAT refunds – instead of 60 days, the money goes to the company in as little as 40 days. The correction of invoices is faster and easier. Entrepreneurs who use KSeF also do not have to issue duplicate invoices, because everything is in the system. Reporting obligations are also simplified. If a company has all its invoices in KSeF, the obligations to submit JPK_VAT are significantly reduced. It is also important that KSeF ensures the archiving of documents for 10 years.
