KSeF signed and published
On 7 August, the President signed a law introducing the mandatory National e-Invoicing System (KSeF) into the Polish legal order. On 11 August, the act was published in the Journal of Laws under item 1598.
Based on the provisions of this act, the e-invoicing obligation will, in principle, enter into force on 1 July 2024, and for small and medium-sized VAT-exempt companies from 1 January 2025.
Recall that from 1 January 2022, taxpayers can use KSeF on a voluntary basis in preparation for the system that will be mandatory from the middle of next year. Currently, the e-invoice operates as one of the permitted forms of documenting sales, alongside paper invoices and electronic invoices already in circulation. The KSeF is to introduce a uniform e-invoice standard, which is to, as the Ministry of Finance emphasises, ‘simplify the documentation of transactions, speed up and automate the issuing, processing and archiving of these documents’.
– However, before entrepreneurs can feel the benefits of KSeF, as announced by the Ministry of Finance, they will have to prepare for its implementation and practical application. One of the key factors is the adaptation of company systems, which may prove to be a demanding and lengthy process. Therefore, it is worth starting implementation work in companies in this area today, suggests Grzegorz Arczewski, tax adviser, senior manager at Thedy & Partners.
