Employer Gifts: Donation or Income? How to Avoid Tax Pitfalls
Not every gift from an employer is subject to PIT (Personal Income Tax)! Tax interpretations indicate that, under certain conditions, gifts from employers can be classified as donations rather than employee income. What does this mean in practice?

If given occasionally, aimed at maintaining good relations, showing appreciation, or expressing gratitude, they can be considered donations rather than income. In such cases, as long as the value of donations from one donor does not exceed 5733 PLN within 5 years, the employee will not be liable for inheritance and donation tax.

It’s different when a gift constitutes part of remuneration, a reward for work, or is regulated by internal company policies – in this case, it is subject to PIT, just like any other benefits arising from an employment contract.

It’s worth carefully analyzing the purpose and circumstances of giving gifts to ensure they are properly classified and determine whether PIT obligations apply. Proper qualification can sometimes save both the employer and employee from additional formalities and taxes.
