E-invoices passed by the Sejm
The Sejm has passed a draft amendment to the VAT Act, which provides for the implementation of the National System of e-Invoices (KSeF). The same amendment also provides for certain simplifications in invoicing.
As we have already reported, in the first phase of e-invoicing implementation, entrepreneurs will use it voluntarily. It will simply be one of the acceptable forms of documenting sales, alongside paper invoices and electronic invoices already present in economic circulation. From 2023, the national system of e-invoicing will be compulsory.
– By implementing the KSeF, the Ministry of Finance is trying to encourage entrepreneurs to choose this form of documenting sales. One of the benefits of this step is a faster VAT refund – within 40 days instead of 60. The MF also stresses that using the new invoicing system will save entrepreneurs the trouble of archiving documents, as they will be in the government system,” says Andrzej Kapczuk, tax advisor, partner at Thedy & Partners.
The amendment will also abolish the obligation to mark invoices with the word “Duplicate” when they are lost or destroyed. It will also no longer be obligatory to mark invoices as correction or adjustment and to indicate the reasons for the correction.
Now the Senate will deal with the amendment.
