BI: Revolution in property tax. Breakthrough judgment of the Constitutional Court
The Constitutional Court ruled today that the tax provisions defining the definition of a structure are unconstitutional. For more than 30 years, companies have been arguing about this in the courts. Now the government and the Sejm have 18 months to prepare new regulations, writes Business Insider.
According to Michal Nielepkowicz, tax advisor, partner at Thedy & Partners and the company’s attorney, this is a very important and good ruling. – Taxpayers have been pointing out the need for changes to the definition of constructions for years. I applaud the TK for deciding to repeal this imprecise provision after so many years of litigation,” comments Michal Nielepkowicz.
He adds that this means that property tax regulations will have to be rewritten. – We have been calling for this for a long time, pointing out that – as experts in this area – we are at the disposal of the Ministry of Finance, adds Michał Nielepkowicz.
The expert points out that the ruling will not take effect until a year and a half from now, so in the ongoing proceedings taxpayers can claim that the definition of a structure is unconstitutional.
