Property Tax in 2025: Which Assets Are Really Subject to Real Estate Taxation?

The latest amendments to Poland’s real estate tax regulations introduce new definitions and compliance requirements. Proper identification of taxable assets is now one of the biggest challenges for both businesses and tax advisors.

Recent changes in real estate tax regulations have raised significant uncertainty among taxpayers and advisors. New definitions and classification rules may substantially affect the amount of tax liabilities for companies.

Practical guidance on how to navigate these changes is provided by Krzysztof Iżel and Paweł Wyporski from the RET team, in the book “Accounting and Tax Instructions”, edited by Artur Hołda and published by C.H.Beck.

Their contribution, titled “Instructions for Identifying Taxable Assets”, is a hands-on guide designed to help businesses correctly determine whether a given asset is subject to real estate taxation. The chapter includes:

  • step-by-step tests and identification procedures,

  • practical classification examples,

  • analysis of challenging cases – from temporary structures and containers to warehouse docks and industrial installations.

According to the authors, accurate asset identification is essential not only for correct tax settlements but also for minimizing the risk of disputes with tax authorities.

This publication is a must-read for financial managers, accountants, and tax advisors responsible for ensuring compliance with the new real estate tax framework.
