New Safe Harbour Rules for Loans in 2025: Key Updates
As 2024 comes to an end, significant changes to transfer pricing regulations are already in effect for 2025. On December 27, the Ministry of Finance published an announcement in the Monitor Polski introducing adjustments to baseline interest rates and margins under the "safe harbour" framework for loans. These changes are effective from January 1, 2025.
What has changed?
- Lower Margins: The maximum margin for borrowers has been reduced from 3.1 percentage points to 2.6, while the minimum margin for lenders dropped from 2.2 percentage points to 2.0.
- LIBOR Excluded: LIBOR-based interest rates for USD and GBP loans are no longer applicable. The baseline interest rates are now SOFR for USD and SONIA for GBP.
These adjustments are an essential step in aligning Polish regulations with international standards. Businesses are encouraged to review these updates to ensure compliance and make the most of the simplified “safe harbour” mechanism.
